Terms & ConditionsThis document sets out the terms and conditions for the use of Travel Websites Directory (a trading name of Really Useful Websites Limited, registered in England number: 5754035) by travel companies and travel websites. People using this website for private information gathering purposes (such as, but not limited to, consumers or members of the public, or travel company and travel website personnel also using the website for private information gathering purposes) are classified as 'Users', who should refer to our 'Disclaimer', 'Copyright' and 'Privacy Policy'.In these Terms and Conditions 'we, our, us' refers to Really Useful Websites Limited and/or its trading divisions, such as, but not limited to, Travel Websites Directory. Really Useful Websites Limited is registered in England and operates websites which are aimed at a UK audience. Travel companies and travel websites based overseas are welcome to submit themselves for inclusion in our directory, but in doing so they acknowledge the 'Governing Law and Jurisdiction' terms outlined below. ACCEPTANCE OF TERMSBy accessing www.travelwebsitesdirectory.co.uk ("the Website") you agree to be bound by these terms and conditions and you accept our Privacy Policy, which is available elsewhere on the Website.If you object to any of these terms and conditions you should not use any of the products or services on the Website and you should leave immediately. You agree that you shall not use the Website for illegal purposes, and will respect all applicable laws and regulations. You agree not to use the Website in a way that may be detrimental to its performance, corrupt the content of it or otherwise reduce the overall functionality of the Website. You also agree not to compromise the security of the Website or attempt to gain access to secured areas or sensitive information. You agree to be fully responsible for any claim, expense, liability, losses and/or costs (including legal fees) incurred which arises from any infringement of these terms and conditions by you. MODIFICATIONReally Useful Websites reserves the right to change any of these terms and conditions without notice or liability and your use of the Website will be deemed as acceptance of these changes. We advise you to regularly check these terms and conditions in order to ascertain if any such changes have been made.LIMITATION OF LIABILITYUnder no circumstance will Really Useful Websites Limited be liable to you for any indirect, special, or consequential loss or damages or for any loss of business, revenue, profits, or data in relation to your use of the Website.GOVERNING LAW AND JURISDICTIONThese terms and conditions are governed by the laws of England and you agree to be bound exclusively by the jurisdiction of English courts without reference to rules governing choice of laws.SUBMISSION OF WEBSITES TO TRAVEL WEBSITES DIRECTORYWe reserve the right to accept or decline websites for inclusion in the website, paid for or free, and, at any time, to amend any of the content of the listing as we see fit. We also reserve the right to change the criteria for inclusion in a category and sub-category, to amend the categories and sub-categories and to remove categories and sub-categories from the Website. This may change the categories and sub-categories that your listing appears within and, although unlikely, if your listing no longer has a relevant category and/or sub-category to appear within, we may remove your listing from the Website accordingly.We may also withdraw a listing from the directory at any time if we decide it is no longer appropriate, or where you are in breach of our terms and conditions. For the avoidance of doubt, if a paid-for package has been purchased, we may also withdraw such listings from the directory at any time for the reasons stated above or for any other criteria that are introduced or changed by us. We also reserve the right to change the format and/or design and/or content and/or trading name/domain name of the Website at any time. In all such circumstances outlined above, no refund of monies paid to us will be made and in submitting your website for inclusion in the Website, you agree to these terms and conditions. PACKAGESWhen you pay for a package, you are paying for us to review the website concerned to assess its suitability for the Website and to review and upload your enhanced listing (and if relevant your profile page) to the Website. On certain packages, you also are paying for your listing to appear randomly in a 'Featured Listings' section on page one of each category/sub-category in which your listing appears.If your website is deemed unsuitable by us, we will let you know. In most circumstances we will refund your payment, though we reserve the right to keep all/or part of your payment to cover our administration expenses. Once your website and listing has been approved and subject to your website remaining applicable and you adhering to our terms & conditions, your listing can then remain in the Website free of charge for up to one year. We also provide, free of charge, other package features, such as, but not limited to, the facility to make amendments to your listings, the review of any such changes by us and an account/online facilities to manage your listings. These features are subject to change or withdrawal at any time by us, without compensation, and we reserve the right to make a charge, at our discretion, where excessive amendments to listings are submitted, which will also be deemed a breach of these terms and conditions. As outlined above, when you submit a listing under a paid-for package, you are paying us to undertake the necessary work to approve and upload your listing. Our work begins when you submit your listing and as such the expiry date will be twelve months from the date at which you submitted and paid for your package, not the date on which the listing was approved and uploaded. If you do not make an online payment, then we reserve the right to upload your listing only once your payment has been received. In such circumstances your package will expire one year from the date at which you submitted your package to us. It is a condition that we review your website and listing on an annual basis and therefore upon your package expiry date, you will be required to pay for this review and for the continuation of the paid-for applicable package features. The package price payable will be the price advertised on the Website at the time that your package expires. If you do not renew your paid-for package then your listing will be removed from the directory. Once a paid-for package has been taken out, no refunds are available in relation to time remaining, should you decide to withdraw your listing. If you decide to upgrade a listing from one paid-for package to another, then you are taking out a new package which requires that we undertake the same procedures as for new paid-for packages, and you will therefore be required to pay the full price of your new package from the date at which you upgrade. The upgraded package will then require renewal at its expiry date, which will be set using the criteria outlined above. No refunds or discounts will be made in respect of any time remaining on your previous paid-for package. If you take a package whereby your listing appears in the 'Featured Listings' section, you acknowledge that no guarantees are made as to how many times your listing will be displayed in this section. If there are more than a certain number (to be determined by us) of listings in any given category/sub-category, which sign up for the package which includes 'Featured Listings', then these listings will be rotated into the 'Featured Listings' section in turn. We make no guarantees or warranties in relation to the volume of traffic that will view your listing, nor of the number of people who will click through to your website, nor the appropriateness of any users who click through to your website. Where your package includes the facility to include contact details, you will supply contact details (telephone number and/or email address) which will be answered in a customer friendly time frame. If you operate an affiliate scheme, whether through an affiliate network or in-house, it is a condition of your inclusion in the Website that we have the right to operate all links to your website from your listing and/or any other content area of the Website on an affiliate basis. Whilst Bronze packages may be allocated free of charge to listings which operate on an affiliate basis, all paid-for package upgrades purchased for affiliate listings will also operate on the terms offered to us under your affiliate scheme, in addition to the payment due for the provision of the package selected. LISTING UPDATESWe may provide certain packages with the facility to update elements of your listing live, via your account. We check all amendments but you agree not to change the content of your listing to contain unsuitable material or to upload any unsuitable images to your logo, where your package allows one. Likewise, you agree not to change your listing to attempt to misrepresent the nature of your business and the products/services you offer/sell.Misuse of the update facility and/or the uploading of any unsuitable content shall be deemed breach of these Terms and Conditions and we reserve the right to cancel your package (and all other listing packages under your account) with immediate effect should this occur. Your listing(s) will be removed from the Website and no monies will be repayable. You can also submit changes to other elements of your listing(s) via the contact form on the website. We will review these requests but reserve the right not to accept or action these requests unless they are essential for the accuracy of your listing(s). The submission of excessive updates, whether live via your account or via the contact form, will also be considered a breach of these Terms & Conditions. The level of updates that are considered excessive is at our discretion, though we will let you know if we consider that you are approaching this limit. PRIVACYOur 'Privacy Policy' applies to you if you are a private user of Travel Websites Directory as well as a company user.As a company, it is a condition of your inclusion in the Website that we hold certain information about your company and that you keep your contact details up to date. Any element of the information held by us which is classified as "Personal Data" is also protected in accordance with the procedures outlined in the Data Protection Act 1998. We will not share this data with any third party outside of the Really Useful Websites group, unless we have your permission or are required to do so by law. COPYRIGHTYou agree to respect our Copyright. This website and all of its content is the copyright of Really Useful Websites Limited.You are free to link to us, either using a hyper-link or one of the links we have provided on our 'Link To Us' page. In linking to us, you agree not to misrepresent the nature of our business. OTHERAll the above terms and conditions shall also apply when a listing is offered free of charge, for example if a website links to Travel Websites Directory.In informing you of where we obtain our advertising and providing links to these third party providers, we are not recommending them as suitable for your business needs and you should make your own enquiries in this regard. Should Travel Websites Directory and/or Really Useful Websites Limited, be sold to another business, these Terms & Conditions may change to those of the new owner. Although we will attempt to inform you of any such change of ownership we make no guarantees that we will be able to do so. You should check these terms and conditions regularly to ensure they are acceptable to you.
